Just goes to show you that if you think about it, just about anything can be copyrighted and the one who thinks of it first gets the roylaties. BTW, a trademark is for logos or symbols and a copyright is for words or expressions... After much trial and error on the Mac version here with my Pinnacle and Sony CDR mechanisms I am sad to report that Toast will NOT write audio CD's in DAO (DISC AT ONCE) mode. While I think the term "stealth microphone" is a good attempt to carve out a unique niche in an increasingly competitive field, it's a 'too common' descriptive phrase that'll pee-off most people with restrictive use and I have some convincing arguments to its exclusive ownership by Core as a trademark. BACKGROUND Trademarks and Registered Trademarks are identical claims with an actual Registered TM being more formalized by having been through search and cost incurring some simple legal procedures. A "TM" symbol itself is not a registered claim and is quite commonly used as a "common process of creation of exclusive ownership" as there's about three-five years 'of holding your breath time period' whereafter it's essentially as valid as a Registered TM (shown as a "Circled R" symbol) as a convincing argument in court. But ONLY if not challenged by anyone who objects to the owner's claims to propriety of a phrase or term or whatever. If not actually registered, just the letter TM symbolizes an informal claim that awaits enough time 'unchallenged' to be arguably owned. If registered, then it must be shown as a circled "R" symbol. If it's not registered, but is shown as a circled "R", then the person claiming this is registered may be fined by the Trademark & Copyright Department. Written claims that a TM is registered may also be cause for liability to being fined. If the TM is not challenged in the critical years and the owner can claim the business involving the TM usage covers a particular wide geography, then the TM's owner and usage is fairly established and presents a good argument to any challenge within the Geography of "doing business" using this TM exclusive to others operating in the same shared geography. In other words, if sending merchandise worldwide with the term "stealth microphones" as "Trade Marked" is not challenged by anyone in a certain amount of years, then this is about as good as it gets for having a likely winning argument of TM ownership if later challenged by anyone who also wants this usage "freed" for liberalized use in the literature and for description of similar products by others worldwide. NOW, Even if someone actually registers a term like "stealth microphone" formally, another party who has used this term to describe his product and has had a similar product described in the literature for over three years with sufficient Geographical sales without challenge, is most likely to lay ANY claim of ownership by others aside and may actually claim OWNERSHIP of terms like "stealth microphone" as their own with convincing legal argument against future challenges. In fact, my own microphones have been described more than a few times as stealth in marketing and Mag Review literature dating back to at least 1989. Maybe I should look into registering or just claiming for myself this term to shut out all others from using the words "stealth microphone" in E-mails and descriptions of his and other similar microphones as Mr. Moskowitz seems to desire if left to his own about this. I personally don't mind so much about others using the "stealth microphone" term, but I am a little concerned that someone has recently excluded any others from using the term without also mentioning that the term is claimed exclusively owned by somebody who didn't have the original 'stealth microphone' by at least 5 years! AND now has made a claim on the "stealth mIcrophone" term after literature usage predates this claim by at least 8 years. Nice try, but I'm thinking NO 'tm' CIGAR for you on this one Mr. Len! For just one such example, please look at the 1991 (Vol. 18 No.4 August Edition) Relix Magazine Review of the DSM-5L microphones by Barry. In this review he mentions (in the same paragraph) how using Sonic Studios DSM-5L microphones is "the epitome of stealth taping" as anyone wearing them can be continuously recording while walking through a crowd without anyone having a clue. As the most likely documented pioneer having a "stealth" described microphone product, I unconditionally grant the "stealth microphone" term for use by ANYONE who wants to use it in E-mails, labeling of their microphones, or even writing in slogans on buildings ..... no permission required ............. this of course INCLUDES Mr. "stealth microphone" Moskowitz who really does make several small & unobtrusive type microphone models as also do the Sound Professionals, Oade, and others (like the spy shops) based at locations here and overseas; all of their small mic products can be described as candidates for 'stealth microphone' sound recording requirements! While it usually doesn't hurt to try to claim ownership of 'truly unique' phrases and terms to gain a distinction from your competition, you have to realize that with trademarks (registered or not), it's a lot like a traditional marriage ceremony where the call for whomever wishes to speak or (virtually) forever hold your peace before the TM 'knot' is made is a 3-5 year pause for someone to speak up. Well, I say call off the marriage as I object on grounds of having precedent in claiming the right to own or, as in this case grant public domain use of the aforementioned term. He once needed a tape of mine to complete a Morphine show he was burning onto CDR. I gave him the tape on a Monday nite. When I left for work on Tuesday, my tape was in the mailbox along with fresh CDR's of the show. We're talking an 8 hour turn around. Now how many of you on this list have ever had a trade like this??
