Actually, it was ROT-13 that got the Russian in trouble. (Some idiot
publisher of ebooks used ROT-13 to "protect" its contents, and he
revealed that fact.)
(Also, he worked for a company that broke Adobe's weak encryption.)

handling most of the vocals on this tour and him,

"Shine" CD and from some of Craigs other CDs. Rumour

I am liquidating my DAT collection and dat decks. I just don't listen to
them any longer.
1) DAT tapes ($1.50 ea) about 200-250 DAT tapes (90m and some 60m), with GD,
Phish, and other assorted music on them. Mostly Sony and Maxell brands,
labeled and unlabeled. Will sell in lots of 50 for $75 per lot plus shipping
costs.
2) Fostex D-5 ($375), excellent condition, less than 100 hrs on new head
installed and serviced by Oade brothers. Plus shipping.
3) Sony DTC-75ES ($125), serviced by Paul Plotnick at Pro Audio 3-4 yrs ago.
Some tapes played on it have occasional dropouts. May need adjusting.
Otherwise works great. Plus shipping.

just thought i'd let you know about a few problems i
have been Recently discovering. had a nostalgic night
and listened to a few choice dylan recordings done
during 97. the two CDR failures? MAXELL CD-R 74H. I
thought these things were cool at the time because
they were "gold" on the bottom, AND gave me
74:4something for those special instances where i
needed a "good" disc that was over 74:04. WELL, I WAS
WRONG. there is not a problem with the cdr800 yet two
of the MAXELL CD-R74H discs register as NEW DISCS now.
call me stupid, but i'd take whatever is important (or
impotent if you don't) and get it off of this shit if
you have it. i will admit, back then, i wrote on CDRs
with a sharpie pen. lots of you probably did too. i do
not know it this has anything to do with it but use
good CDs for the important transfers.
PS/. never get rid of your masters....
cuz the guy who you gets them may care even less than
you do.

In my opinion this guy is right on all counts.
He sounds sincere and probably is not the "bad trader" you think he is. I doubt
that he is a trader at all.
There have been cases where this constitutes "defamation" and has been
actionable, especially after you have been notified of your error. To continue
to post his name can be shown to be deliberate defamation since you've been
notified that it is wrong.
Give the guy a break and remove his name from your page. You would not like it
if someone else put your name on the Internet in such a way as to cause you to
lose face. He doesn't deserve it either.

Allright, so I'm taping last night and "something" mysterious happened, I
haven't determined what as the batteries all seem ok, but everything was
going fine and then static burst and cutout of recording. So, if anyone has
BOC 3-1-02 Toad's Place available I'd appreciate a full copy. If it turns
out it was battery related I'm gonna be pretty mad as I could have cut
taping one of the openers. Figures - the one time I don't run my MD rig
parallel to the DAT as backup, this happens. Please anyone if you have this
yet me know off list.

if he is sincere, then yes, he is not a trader at all...that is what he said

i'm unclear on how this works i guess, as are most people judging from the
responses i've been getting
i can't believe this, but EZ may be right, and i may end up consulting a
lawyer on this....sheesh!!
i would appreciate it if EZ, or anyone, can direct me to stories/case
law/whatever on this type of thing so i can read about it for myself

for now i am sticking with my decision posted yesterday (that i am doing
nothing, not even responding to his email)
the guy really rubbed me the wrong way, i just don't believe him at this
point....perhaps if he had expressed it differently, did not include the bit
about threatening to take action against me, i would have been more open to
discussing it with him and not even brought this up on datheads to get other
takes on it
could i be making the wrong decision on how i have decided to handle this?
absolutely
anyway, as i stated yesterday, for now i am not doing anything
of the 30+ people that responded to me so far, the sentiment is running
about 10 to 1 with the following consensus:
- it is more likely that he is the original guy playing mind games than
someone else with the same name/same town getting upset about a "bad trader"
warning
- or, assuming that he is sincere, that he is getting worked up over
nothing; because the worst thing my telling the story on my bad trader page
can do to him is to have people be wary of trading with him, and since he
does not even trade, why should he even care? most people don't get the
"defamation of character" angle...read the story on my website if you
haven't, it's not like he is being outed as an evil murdering baby killer or
something
- that i am within my rights to discuss the bad trader situation on my
webpage; the fact that the names/towns may match with this guy is a simple
wierd twist of fate...he said so himself that he has a COMMON name..what is
he going to do when one of his name brethren get dragged into traffic court
for driving drunk & have their name published in the newspaper? what if one
of the other M.K.'s gets into a scandal & has his name mentioned somewhere
for whatever reason? what if his name was "osama bin laden", does the all
the bad press that that guy gets affect him?? of course not....getting so
worked up over my bad trader warning doesn't make any sense to most of the
people that responded to me
- with him being in the UK, and me being in the USA, that he can hold his
breath until he turns blue and that will do me as much harm as him taking
some kind of legal action against me
- for anyone that does a search on their name on the internet, they will
uncover ALL manner of strange things which actually have nothing to do with
them and some that they will not like at all....that it is crazy for a
non-trader to care about my bad trader warning
also relating to this, at the very top of my bad trader page i state very
clearly that the people that i am discussing below are "bad traders" IN MY
OPINION....that there could be other explanations for why they never made
good than just them being "bad traders"...how any of this can be taken so
seriously as "defamation of character" etc, especially by someone OTHER than
the person i discuss, is something i continue to be mystified by
if something further develops on this, to change my mind about this other
person's autheniticity & sincerity (which again, in my myopic view, why if
he is not the original guy how can he care about my bad trader warning,
which is not written in an inflammatory way at all btw), i would be willing
to alter the warning in such a way to be clear that he is a different person
than the "bad guy" or whatever, but i will not REMOVE my bad trader warning
on the original guy under any circumstance other than the original guy
explaining what happened to our trade (did he forget? did he get sick? will
he apologize? will he make good on what he owes? etc)
