I just hate it when I get a traded CD-R and some idiot didn't copy it right (example, the disc isn't DAO recorded) I will say that I have experienced CD-Rs that aren't exactly perfect when they were burned at a high rate of speed. Somewhere the data gets changed slightly which is probably the differences you are experiencing. But that's why the software will also let you slow down the burn rate. I no longer burn above 4x on the computer. A full disc may take 20 minutes to copy from the hard drive, but it won't have any digital errors either because of the slower burn rate. For my most important recordings (like transfer of Live DATs to CD-Rs) I burn at 1x of course with home audio gear. A Sony DAT deck with fiber optic out to a Marantz CD Recorder with SCMS turned off. 75 minutes may take 75 minutes, but at least I can watch to make sure the Track IDs transfer properly and fade in and out at the being and end of the disc like I want to, Digitally! And because this burner records digitally with a sample rate converter for 48K DATs, when I do dub the first disc and continue on to the tenth disc, the tenth will sound like the first one exactly because it was done digitally! Date: Tue, 22 Jul 2003 18:15:31 -0400 .....but a band does not have to pay the artist who wrote a song or the publisher of that song every time they play that song live in concert (assuming they did not write the song of course) for example - Grateful Dead cover bands do not pay Robert Hunter or his publisher etc. to play Grateful Dead songs live... if they had to do that - they would owe the publisher much more than the $$ they got paid for the gig in the first place....... the only way that would happen would be if the band officially released the live recording for sale to the public..... for example - Government Mule had to get permission to release the live recording of them performing Humble Pie's "30 Days In The Hole". There are all kinds of ways this is negotiated and finalized so that the original song writer(s) get compensated via his publisher. But even that has to do w/ the deal that the songwriter originally made w/ the publisher.... In some cases, the publisher get the $$ and the songwriter gets nothing...... if I got up during setbreak and performed Ripple on my acoustic guitar in front of a crowded bar - nobody could collect any money from me for playing the song..... but if the song was recorded and I wanted to sell it, I would have to get permission from Robert Hunter, Jerry Garcia's estate (I guess) and work out a financial deal w/ the publisher.... depending on what arrangement was made w/ Hunter & Garcia w/ the publisher originally..... attorneys - please correct me if I am wrong - Peace, D ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ From: Wayne Bonomo <waynomo2@cox.net> Subject: Re: [BUDD] Big brother IS watching... If this is the case it would take someone with a much better knowledge of copyright law to interpret this. This could potentially be a can of worms for the music trading community. Can a performer allow the free distribution of recordings of songs performed by them, but authored by someone else? Does your show list also list songs performed? Removing the song list might be one way to at least make the job more difficult for these people. I guess this should also be a warning to anyone who posts shows of performers who are not taper friendly that big brother is indeed watching and may be coming for you. Wayne

That sin't entirely true. A cd is actually digital music, not quite the same as data. SHN's, with their checksums, and specifically data cd's are DATA. Music cd's are music. That's why some cd burners require MUSIC cd's. It's also why you can put a 24 track song on a cd as DATA, but can only record a 2 track MUSIC version. There is some overlapping error correction, and other digital wonders that happen inbetween, but there are differences that need to be understood. It's been some years since I was in school for audio recording, and some of those specifics escape me right now, but there are differences! As far as Big Brother watching and writing to you, I would have to agree that the reason they did was because of the cover songs. If they are old enough, they may be public domain, and I believe the songs mentioned ARE public domain. A quick call or email to the Library of Congress, or one of the big music royalty companies will tell you. The letter could also be written because big music exec's don't understand why people would actually give music away, and not sell it. They make big $$$$ because they sell music (and usually screw the artist at the same time), but are basically just like a stock broker. Passing along a copy of that cover will not pass along anything to JJ Cale, nor WSP. Cover tunes are a problem. If the shows all on your list only contained WSP songs then you would have no problem.
