Although I don't have any verifiable proof beyond
these two separate-but-related first-person accounts,
it seems the time has come for international traders
to exercise extreme caution and careful judgment when
sending packages, especially with live shows,
overseas.

Hi all,
I wanted some opinions/feedback etc on something if I
could from youse
guys. A friend of mine just posted this to a 'private
group' I'm on,,,
basically a small group of similar interests where we
trade a very
particular type of music which most are NOT interested
in-- which
explains the small element I mentioned. If you could
read the below
posting and LMK what you think? I tend to not believe
it myself but one
never knows. Thanks!

Again, for some reason, I feeel like this is a Chicken
Little story but
if you've heard anything could you give a web site
addy or pointer to
the original story?
Any help appreciated....

i think they were taper friendly at first, and
then there was a brief period when no taping was
allowed... but now it is ok again and
they have a taping policy outlined on their
website...
http://www.nickelcreek.com/faq.htm
if you read the whole thing, the are ok with
almost all forms of audience audio recordings...
mic stands are ok as long as venue approves...
but if the venue us against taping, then they go
along with the venue's policy
and they are only ok with trading their live
shows in person or by mail... but they are
against digital downloads of their shows.

yes, it appears to be for real (?)
here is a link for it
http://story.news.yahoo.com/news?tmpl=story&u=/afp/20040211/en_afp/finland_i
t_internet_040211195603
it happened in finland
from reading the article it says he was fined something like $500, not
$72,000 though, but the whole thing is pretty crazy regardless IMO
he was also ordered to pay alanis morrisette around $8000
i'm sure that this story will be spreading like wildfire all over the
internet amongst various trading groups, with many many distortions among
some facts being passed around as well...sure to cause plenty of hysteria
along the way
IMO there must be more to the story, but i really dunno....for instance,
what did the guy do to get into the finnish courts' radar? why was this a
concern for them? i would imagine that there are thousands of people in
finland who trade "unreleased" material, don't they have enough "real"
crimes to prosecute?? what made this guy trading so "special" to warrant a
day in court??
i'm going to go out on a limb & guess that alanis/her management were upset
about seeing her "bootlegs" freely traded by this person, & initiated legal
proceedings to stop him from doing that (& to "punish" him)....i'm saying
that because it seems like she was the main focus artist-wise of the article
i am not a copyright lawyer but it makes sense to me that an artist/original
copyright owner could choose to sue someone "using" their work without their
consent, although in this case i consider it misguided
to paraphrase something i remember from a 3 stooges' short - "this house
sho' gone crazy!!"

A google search on "nickel creek" "taping policy" turned up the following

From: Doug Roerden <roerden@bedrockbarn.com>
Subject: Troubleshooting Sony TCD-D7 Optical Output
Date: Tue, 17 Feb 2004 23:51:42 -0500
DAT-Heads:
I have a Sony TCD-D7 for which I purchased a TOSLink cable. I finally
got an Mbox to carry the digital signal into my Mac. Of course, I had
to buy a CO2 Coaxial-Optical Converter from M Audio to go from the
TOSLink optical to the Mbox Coax. Anyway, I can't seem to get a digital
signal into the Mbox and don't have any gear to swap in and out to
troubleshoot. My fear is the TOSLink cable and my bigger fear is the
DAT recorder itself. Any ideas for troubleshooting? The TOSLink Out
gives a nice red glow but the In doesn't look like it's made to go into
the CO2. Headphones hooked into the Mbox front or back panel yield no
results. It's supposed to...right?
Any information greatly appreciated.
